  • "We," "Us," "Our" refers to Zephyrine, a property leasing service operating in Johor Bahru, Malaysia.
  • "User," "You," "Your" refers to any individual or entity using our services or accessing our website.
  • "Property" refers to residential real estate available for lease through our service.
  • "Agreement" refers to these Terms and Conditions together with any lease agreements or service contracts entered into between parties.
  • "Landlord" refers to the legal owner of a property listed through our service.
  • "Tenant" refers to an individual or entity leasing a property through our service.

2. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

You must be at least eighteen years of age to use our services. By using our services, you represent and warrant that you have the legal capacity to enter into binding agreements under Malaysian law.

3. Service Description

Zephyrine provides property rental services in Johor Bahru and the Iskandar region. Our services include:

  • Property sourcing and portfolio curation based on client requirements
  • Accompanied property viewings and neighborhood orientations
  • Lease negotiation and documentation support
  • Background verification and application processing
  • Property assessment and quality evaluation
  • Post-occupancy support through dedicated property liaisons
  • Maintenance coordination and tenant assistance

We act as intermediaries between landlords and prospective tenants. We do not own the properties listed through our service and are not party to lease agreements between landlords and tenants, except in our capacity as leasing agents.

4. User Responsibilities

4.1 Information Accuracy

You agree to provide accurate, current, and complete information during registration, property inquiries, and lease applications. You must promptly update any information that becomes inaccurate or incomplete.

4.2 Acceptable Use

When using our services, you agree not to:

  • Provide false or misleading information in applications or communications
  • Misrepresent your identity, employment status, or financial capacity
  • Attempt to circumvent our background verification processes
  • Use our services for any unlawful purpose or in violation of applicable regulations
  • Interfere with or disrupt our website or services
  • Access or attempt to access unauthorized areas of our systems
  • Engage in any form of harassment or abusive behavior toward our staff or other users

4.3 Property Viewings

When attending property viewings, you agree to respect property boundaries, follow viewing protocols, and treat properties with care. You are responsible for any damage caused during viewings due to negligence or misconduct.

5. Lease Agreements

5.1 Application Process

Property applications are subject to landlord approval and background verification. We reserve the right to decline applications that do not meet property requirements or fail verification checks.

5.2 Deposits and Payments

Security deposits and rental payments are governed by individual lease agreements. Typical arrangements include two months' rent as security deposit plus one month advance payment. All financial terms are subject to negotiation between landlord and tenant.

5.3 Lease Terms

Standard lease terms range from six to twenty-four months. Specific conditions including renewal options, termination clauses, and maintenance responsibilities are detailed in individual lease agreements. Tenants are responsible for reviewing and understanding all lease terms before signing.

6. Service Fees

Our service fees are typically borne by landlords and are calculated as a percentage of annual rent. Tenants are not charged separate service fees unless otherwise agreed in writing. Any additional charges for specialized services will be clearly communicated before provision.

Rental rates quoted are subject to landlord approval and may change based on market conditions or property availability. All pricing is in Malaysian Ringgit (RM) unless otherwise stated.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Zephyrine or its content suppliers and is protected by Malaysian and international copyright laws.

You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

Property photographs and descriptions are provided by landlords or property owners. We make reasonable efforts to ensure accuracy but do not claim ownership of these materials.

8. Disclaimers

8.1 Service Provision

Our services are provided "as is" without warranties of any kind, either express or implied. While we strive for accuracy and quality in our services, we do not warrant that:

  • Properties will be available as advertised
  • Lease applications will be approved
  • Properties will meet all tenant expectations or requirements
  • Our website will be uninterrupted or error-free
  • Defects will be corrected immediately

8.2 Property Condition

While we conduct property assessments, we are not qualified building inspectors or structural engineers. Tenants are encouraged to conduct their own inspections and obtain professional assessments before committing to lease agreements.

8.3 Professional Advice

Information provided through our service does not constitute legal, financial, or tax advice. Tenants should consult appropriate professionals regarding lease implications, tax obligations, and legal rights.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Zephyrine shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use our services
  • Property condition or suitability issues
  • Disputes between landlords and tenants
  • Failure to secure desired properties
  • Loss of data or business interruption
  • Actions or omissions of third parties including landlords, contractors, or service providers

Our total liability for any claims arising from our services shall not exceed the service fees paid by the claimant for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Zephyrine, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your violation of any applicable laws or regulations
  • Your breach of lease agreements
  • Your misrepresentation of information
  • Your negligent or wrongful conduct

11. Termination

We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, our business interests, or third parties.

You may terminate your use of our services at any time by ceasing to access our website and notifying us in writing. Termination does not affect obligations under existing lease agreements or financial commitments.

12. Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Johor Bahru, Malaysia.

12.2 Informal Resolution

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Zephyrine regarding use of our services, superseding any prior agreements or understandings.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by our authorized representative.

13.4 Assignment

You may not assign or transfer these terms or your rights hereunder without our prior written consent. We may assign these terms without restriction.
